Terms of use
These Terms of Service ("Terms") govern access to and use of Reeberio business messaging platform (the "Service"), provided by Hobbytronics ("we," "us"). By creating an account or using the Service, you ("Customer," "you") agree to these Terms.
1. The Service
Reeberio lets you manage customer conversations across channels including WhatsApp Business, website live chat, SMS gateway, and GSM gateway; automate replies and workflows; run message campaigns; use AI-assisted responses; and collaborate with your team, subject to the features and limits of your subscription plan.
2. Eligibility and accounts
You must be able to form a binding contract to use the Service, and use it only for legitimate business purposes. You're responsible for the accuracy of your account information, for maintaining the security of your login credentials, and for all activity under your account, including actions by team members you invite.
3. Your responsibilities as a messaging sender
You are solely responsible for:
• Complying with Meta's WhatsApp Business Platform terms and Business Messaging Policy, including obtaining proper opt-in consent before messaging any Contact and honoring opt-out requests;
• Complying with applicable messaging, marketing, and data protection laws in every jurisdiction you send messages into (for example, anti-spam, telemarketing, and consumer-protection laws);
• The legality, accuracy, and appropriateness of the content you send, upload, or generate through the Service, including via AI features and message templates;
• obtaining any consents required from your own Contacts and telling them how their data is used, as their data controller (see our Privacy Policy for how we, as processor, handle that data);
• The conduct of your team members and anyone you grant access to your account.
We may suspend or terminate a channel connection or account that we reasonably believe violates WhatsApp's policies or applicable law, including at Meta's request.
4. Acceptable use
You agree not to use the Service to:
• Send unsolicited bulk messages, spam, or messages to Contacts who haven't consented;
• Send content that is unlawful, fraudulent, deceptive, defamatory, or infringes another party's rights;
• Attempt to circumvent messaging platform policies (including WhatsApp's) or our own plan limits and safeguards;
• Reverse-engineer, resell, or white-label the Service except as expressly permitted under a white-label arrangement with us;
• Interfere with the Service's operation or security, or access it via unauthorized automated means beyond our published API.
We may investigate and take action, including suspension or termination, for violations of this section.
5. Subscription plans, billing, and payment
• The Service is offered under multiple plans (currently Free, Pro, and Business), each with its own message, contact, workflow, team-seat, and API limits as described on our pricing page.
• Paid plans are billed in advance on a recurring basis (monthly or annual) through our payment processor(s) (Lemon Squeezy ). By subscribing, you authorize us and our processor to charge your chosen payment method.
• If you exceed your plan's usage limits, we may restrict further usage of the affected feature until you upgrade or the next billing cycle begins.
• You may upgrade, downgrade, or cancel your subscription at any time; changes take effect as described at checkout or in your billing settings. Except where required by law, fees already paid are non-refundable.
We may change our plans and pricing on reasonable notice; continued use after a price change takes effect constitutes acceptance.
6. Your content and data
You retain ownership of the data you upload or generate through the Service — including Contact records, conversation content, templates, and workflow configurations ("Customer Data"). You grant us a limited license to host, process, and transmit Customer Data solely to provide and improve the Service, consistent with our Privacy Policy.
You represent that you have all rights necessary to upload and process your Customer Data through the Service, including any Contact data.
7. AI features
Optional AI features (automated replies, intent detection, knowledge-base-grounded answers) generate responses using third-party AI models. AI-generated content may be inaccurate or inappropriate in context; you are responsible for reviewing and are solely liable for AI-generated messages sent to your Contacts under your account. Do not rely on AI output for legal, medical, financial, or other decisions requiring professional advice.
8. Third-party channels and services
The Service integrates with third-party platforms — including Meta's WhatsApp Business Platform, Google Firebase (push notifications), and payment processors — that have their own terms and availability outside our control. We are not responsible for outages, policy changes, or account actions taken by those third parties (for example, Meta suspending a WhatsApp Business Account for policy violations).
9. White-label use
If you have a separate written agreement with us to white-label the Service for your own clients, that agreement governs your white-label rights and obligations; these Terms otherwise continue to apply to your use of the underlying Service.
10. Intellectual property
The Service, including its software, design, and branding, is owned by Hobbytronics and our licensors. Except for the limited rights granted to use the Service, these Terms don't transfer any intellectual property rights to you.
11. Confidentiality
Each party will protect the other's non-public business information shared in connection with the Service with reasonable care, and use it only as needed to perform under these Terms.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION, DELIVERY OF ANY MESSAGE, OR THE AVAILABILITY OF ANY THIRD-PARTY PLATFORM (INCLUDING WHATSAPP).
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOBBYTRONICS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWO (2) MONTHS BEFORE THE CLAIM AROSE.
14. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your Customer Data, your violation of these Terms, or your violation of applicable law or third-party rights (including WhatsApp's policies or a Contact's rights).
15. Term, suspension, and termination
These Terms apply for as long as you use the Service. We may suspend or terminate your access if you materially breach these Terms (including Sections 3 or 4) and don't cure the breach after notice, or immediately if required to prevent harm, comply with law, or at a platform partner's (e.g., Meta's) direction. You may cancel your account at any time. Sections that by their nature should survive termination (e.g., Sections 10–14) will survive.
16. Changes to these Terms
We may update these Terms from time to time. We'll update the "Last updated" date and, for material changes, provide reasonable notice (e.g., by email or in-app notice). Continued use after changes take effect constitutes acceptance.
17. Governing law and disputes
These Terms are governed by the laws of Islamic Republic of Pakistan, without regard to conflict-of-law principles.
18. General
If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
